What does the International Court of Justice’s Advisory Opinion of 21 May 2026 mean for the interpretation of ILO Convention No. 169? This note examines the methodological approach adopted by the Court and its implications for the interpretive work of the ILO supervisory bodies, with particular attention to the development of consultation requirements under Convention No. 169.

Saweto: dos capturas en 2026, una memoria para 2032
Twelve years after the killing of four Indigenous leaders of the Saweto indigenous community, in the Peruvian Amazon, two of the main suspects have been arrested. The murders were denounced by the ILO Governing Body in a 2016 report of the ILO Tripartite Committee following a representation under Article 24 of the ILO Constitution. One of those arrested, Hugo Soria Flores, was identified in the GB report as the ‘habilitado’ of the timber company. The firm established a scheme of ‘habilitación’ to exploit Indigenous labour through illegal logging in Indigenous territories in the forests of Ucayali. Yet, under the current schedule for the submission of reports on Convention No. 169, Peru’s next report to the Committee of Experts is not expected until 2032. The case raises a broader question about the effectiveness of the ILO supervisory system when several years may pass before the application of Convention No. 169 is examined again.

During a century, the ILO adopted international labor conventions and recommendations specifically linked to the indigenous issues. In this presentation are examined the main challenges facing by Convention no. 169 to obtain more ratifications despite the unfavorable context resulting from the persistent conflict between the social partners in the ILO regarding indigenous issues. Spain has ratified Convention No. 169. The impunity enjoyed by violations of Convention No. 169 verified by the ILO supervisory bodies should challenge our collective responsibility and receive greater attention in the academic world.
